SELLER TERMS
These terms should be read and accepted in conjunction with our general terms & conditions which can be found HERE.
We, us, UKCE, Puff & Pour means UK Cigar Exchange
You, seller, the seller means the seller account holder
1. SELLER ACCOUNT
1.1 To open a selling account with us and prior to listing your first item for sale, you must provide us with any personal ID, proof of address and other information or documentation that we may request for verification purposes. If you are a business seller we may also require more information including company details, VAT number and UTR etc.
1.2 From the 1st of January 2024 under the new Diligence & Reporting Requirements Regulations sellers may also need to provide their tax reference number; for individuals this will be your national insurance number and for businesses this will be your UTR number. If you are deemed a "Reportable Seller"* then we are obliged to pass on a record of your sales to HMRC. *You may be excluded from this if you carry out less than 30 transactions not exceeding 2,000 EUR with us during a reportable period.
1.3 You agree that any information you provide on your profile is accurate and truthful.
1.4 As part of our seller vetting/verification process you may be asked to provide bank account and/or debit/credit card details. You may also be requested to carry out a test transaction for a nominal amount in order to confirm and verify these details.
1.5 If your account is activated prior to full validation any items you list may be suspended until such a time as we are able to validate your details satisfactorily.
1.6 We reserve the right to decline approval of an account holder and/or withdraw approval at any time.
2. LISTING ITEMS FOR SALE
2.1 We reserve the right to request documentation to verify ownership, authenticity or tax status of any item listed for sale.
2.2 You (The Seller) agree that item descriptions and any other information you submit is accurate and up-to-date. You also agree to provide other documents or extra photos on request.
2.3 We reserve the right to edit, add or amend details of any listing following our own assessment of the details provided and/or condition of items listed for sale.
2.4 You (The Seller) acknowledge that UK Cigar Exchange have absolute discretion on the wording of any item listing.
2.5 Submitted products will undergo an approval process prior to going live on the platform. If any subsequent edits are made after approval the product status will revert to "pending approval" and the edits will need to be assessed prior to re-activation. We reserve the right to decline approval for any item listed for sale.
2.6 You (The Seller) acknowledge that UK Cigar Exchange may retain all information, communications, photos and item details of any listed items.
2.7 You cannot withdraw an item from sale once an order has been placed on it and been paid for.
2.8 Listing items that are found to be inauthentic or fraudulent in any way will incur account closure and a ban.
2.9 When listing an item for sale you will have the option to enable allowing offers on that product. If a potential buyer makes an offer on an item that has this option enabled their offer will be sent to you (the seller) to review. The buyer will be informed once you have accepted or declined the offer. Prices shown pre-offer and pre-checkout include the buyer commission, you must allow for this when negotiating a price with the buyer as this will be included in the final price agreed. In addition any seller fees due will also be deducted from the final price. Offer acceptance is at your sole discretion. We have no involvement in the decision other than to communicate with each party during the process.
3. SHIPPING & ORDER COMPLETION
3.1 Sellers must ensure that items are packaged safely and securely to avoid any damage during shipping. If it is deemed that the seller has not adequately packaged an item then responsibility for any damage to the item during shipping may lie with the seller.
3.2 Wherever reasonably possible sellers should keep evidence and information with regards to the processing of an order including packing photos, tracking details and any other information pertinent to the processing of an order. This information to be provided to us on request.
3.3 Sellers must endeavour to start the order process within 1 working/business day and arrange for shipping as soon as possible thereafter of the order being placed and payment having been received by UK Cigar Exchange.
3.4 UK Cigar Exchange is not responsible for any part of the shipping process that takes place between the seller and buyer.
4. PAYMENT & FEES
4.1 UK Cigar Exchange charges a seller fee for each Item that is successfully sold on our Website. The seller's commission fee will incur a charge for VAT at the prevailing rate. Updated Commission Fees and VAT Charges are outlined HERE and will form part of these terms & conditions.
4.2 Fees will be deducted on successful completion of an order and the balance payment to the seller processed within 48hrs of funds being received by the buyer.
4.3 Balance payments due to the seller may be sent by bank transfer or international wire or by any other means agreeable to both UK Cigar Exchange and the seller.
4.4 Balance payments due to the seller may be made in any currency agreed between UKCE and the seller however the seller must agree to accept any exchange rate fluctuations within 3%.
4.5 Payment can only be made to the named seller and to the verified payment details provided (see clause 1.3).
5.5 You may adjust the prices of your product(s) at your discretion at any time before sale is agreed. You may also decide to allow offers to be made on your items. See clause 2.9 above regarding Accepting/declining offers made by potential buyers. Once an offer has been made and accepted you must honour the agreed price.
5. RETURNS & DISPUTES
5.1 If a buyer wishes to instigate a return for a valid reason (eg missing or damaged goods, items not being as advertised etc) full payment (less original shipping and insurance costs) will be returned to the seller on confirmed receipt of the unused items.
5.2 We encourage buyers and sellers to resolve any disputes amicably between the two parties however we do offer a comprehensive in-house disputes process. Disputes raised before payment has been sent to the seller will be handled as outlined in point 5.4 below. Once payment has been sent to the seller the transaction will be deemed to be "completed" any disputes raised after payment has been sent will enter an arbitration process that may involve legal representations. Once this process has been triggered all parties involved will be contacted by our disputes resolution team with details of the next steps in the process.
5.4 If a dispute is raised by either party after payment has been made to us by the buyer and prior to payment being sent to the seller the transaction will be suspended immediately pending further investigation by our disputes resolution team. This process is free and open to both parties however if it is subsequently found that items are not authentic or fraudulent in any way then an administration fee of a minimum of £25 up to a maximum of 2.75% of the sale price may be deducted from the payment prior to being returned to the seller.
6. GENERAL
6.1 Using our platform for transacting sales of listed items outside of our website environment will result in a ban and the termination of your account.
6.2 Title to all listed items shall remain with the Seller until payment in full has been received and the balance payment has sent to the seller.
